1. Scope & Contract Formation

• 1.1 TapStayOnline acts solely as an intermediary between customers and hotels. The accommodation contract is formed directly between you and the hotel.
• 1.2 These Terms apply to all bookings made via www.tapstayonline.com or affiliated platforms.

2. Pricing & Payment

2.1 Dynamic Pricing:

• Rates fluctuate based on demand, seasonality, and availability.
• Prices are only guaranteed upon full payment and written confirmation.

2.2 Last-Minute Bookings (<72h before check-in):

• Require full prepayment.
• Are non-refundable and non-changeable.

2.3 Taxes:

• VAT (7% in Germany) is included in displayed prices.
• City tax (e.g., €3-5/person/night) is either:
  • Paid at the hotel (90% of cases), or
  • Pre-paid via TapStayOnline (clearly marked during booking).

3. Cancellation Policy

Each rate comes with its own specific cancellation terms, which are clearly displayed at the time of search and booking. We recommend reviewing these terms carefully before confirming a reservation, as policies may vary depending on the hotel, rate type, or travel dates. Non-refundable rates, partial refunds, and flexible cancellation options will all be outlined individually alongside the rate details.

4. Hotel Obligations

4.1 The hotel is solely responsible for:

• Providing the booked accommodation.
• Collecting city tax (where applicable).
• Compliance with local safety/labor laws.

5. Consumer Rights (EU)

5.1 14-Day Withdrawal Right: Does NOT apply to:

• Bookings for specific dates
• Last-minute or dynamically priced reservations.

5.2 Complaints: Must be reported:

• To the hotel immediately during stay.
• To TapStayOnline within 14 days after checkout.

6. Force Majeure

6.1 Includes:

pandemics, natural disasters, government travel bans.

6.2 Options if triggered:

• Full credit voucher (valid 24 months), or
• Partial refund minus actual costs.

7. Data Protection (GDPR)

7.1 Personal data is processed per our Privacy Policy.

8. Governing Law & Disputes

• 8.1 German law applies for EU consumers.
• 8.2 Mediation via European Consumer Centre is required before litigation.
